NCRC To Select Administrator Of MNP

The National Communications Regulation Commission (NCRC) intends to determine before 2011 the company that will administer services allowing subscribers to mobile-telephone services to keep their personal telephone numbers when switching from one mobile-telephone operator to another (MNP - Mobile Number Portability). An informed source disclosed this to Ukrainian News. "It has not yet been announced officially who will administer number portability. The NCRC is presently in the final phase of selecting the administrator. It is a matter of 2-3 weeks," the source said. He did not name the companies seeking to perform this function, but he said that competition for the position was very fierce. As earlier reported, the Astelit cellular mobile telephone company, which provides mobile telephone services under the life:) brand, said in July that it was realistic to begin providing MNP in the first quarter of 2011 on condition of smooth joint work and cooperation between the NCRC, Ukrchastotnahliad (the Ukrainian State Center for Radio Frequencies), and, in particular, mobile communications operators. The MTS Ukraine mobile communications operator has said that it is impossible to introduce this service before July 2011. The parliament voted on July 1 to amend the Law on Telecommunications to grant subscribers to mobile telephone services the right to keep their personal telephone numbers when switching from one mobile-telephone operator to another and directed the NCRC to draft conditions for introduction of MNP within six months.

Rada Introduces State Regulation Of Tariffs For Access To Electric Communication Cable Ductwork

The Verkhovna Rada of Ukraine has introduced the state regulation of the tariffs for access to electric communication cable ductwork. With 226 votes required, 237 lawmakers supported draft law No.5333 on the whole to introduce certain amendments to the law on telecommunications (concerning provision of access to the electric communication cable ductwork). The Verkhovna Rada included the tariffs for using electric communication cable ductwork on the list of tariffs subject to state regulation. The effective wording of the law on telecommunications reads that the following tariffs are subject to state regulation through introduction of fixed tariffs or ceilings of tariffs: tariffs for services of social importance guaranteed by the State, tariffs for provision of usage of channels of electric communications of telecommunication operators that hold monopoly on the market. Authors of the draft law Verkhovna Rada deputies Vitalii Korzh (from the faction of then Bloc of Yulia Tymoshenko) and Yurii Moroko (from the faction of the Party of Regions) noted in the explanatory memorandum the owners of electric communication cable ductwork (Ukrtelecom mostly) independently set tariffs for the access. In the opinion of the authors of the draft law, this situation provides with unfair economic and competitive advantages on the telecommunication market. This situation also stalls the development of networks of some operators and has negative effects on the development of the telecommunication sector on the whole. As Ukrainian News earlier reported, the Verkhovna Rada endorsed the draft law at the first reading with 296 votes on 6 July 2010. According to the National Commission for Regulating Communications, Ukrtelecom is the owner of most of electric communication cable ductwork.

NCRC Expects Announcement On Tender For 3G Licenses Before February 2011

The National Commission for Regulating Communications (NCRC) expects a tender for selling licenses for UMTS (3G) mobile communications to be announced before February 2011. Volodymyr Smoliar, a member of the commission, said this during a roundtable. "[The commission expects] the start of the tender in the second half of January 2011," he said. He said the National Commission for Regulating Communications was adjusting with the Defense Ministry a plan of conversion of radio frequencies for UMTS (3G) mobile communications. The Defense Ministry is likely to endorse a final option of the plan by the end of 2010, he said. According to Volodymyr Smoliar, the draft plan of conversion of radio frequencies fixes the cost of the conversion at UAH 848 million. The time for the conversion is 8 months, according to the draft plan. As Ukrainian News earlier reported, the NCRC used to expect a tender for selling licenses for UMTS (3G) mobile communications before 2011.

State Entrepreneurship Committee Opposes To Rules Of Provision Of Telecom Services Initiated By Communications Commission

The State Committee for Regulatory Policy and Entrepreneurship provided no consent for draft government resolution on approval of rules of provision and reception of telecommunication services, worked out by the National Communications Regulatory Commission, reads a statement made by the Entrepreneurship Committee. On November 15, the Committee received remarks and propositions from the telecom operator Kyivstar, concerning the devised rules. Apart from this, at a sitting on the Ukrainian Union of Industrialists and Entrepreneurs' commission for science and technologies on November 19 they set plenty of remarks from the publicity, that regard the drawbacks of the worked-out rules, and also possible consequences of the state regulation of the telecom sector by the Communications Commission. Taking into account all this, the Committee suggested that the Communications Commission give an extended term for discussion of the relevant draft resolution and consider a possibility of forming a workgroup for this issue, which will include representatives of the telecom market players. The State Entrepreneurship Committee notes, that the failure to give assent for this draft resolution is strictly a technical question, as in keeping with the law on the principles of state regulatory policy in the sphere of economic activity it has no right to reconcile draft regulatory acts if any remarks to its content and propositions from physical and legal entities or their unions. The Committee adds, it will voice its position pertaining the content of the rules of provision of telecom services after the National Communications Regulatory Commission studies Kyivstar's remarks. As Ukrainian News earlier reported, the National Communications Regulatory Commission at a session on October 28 approved the project of rules of provision of telecom services, which among others provide for elimination of charges for connection, targeted informing of consumers when changing rates of services, per-second billing of roaming services.

NCRC Intending To Endorse License Terms For Internet Providers

The National Commission for Regulating Communications intends to endorse terms for carrying out activities on provision of services of access to the Internet. Ukrainian News learned this from a statement by the NCRC. The Communications Commission approved a draft resolution on the matter in principle at its meeting on Thursday. In particular, the terms contain a list of organizational, qualification and technical requirements compulsory for carrying out activities on provision of services of access to the Internet. As Ukrainian News reported, the NCRC is a central body of executive power regulating commutations and mail services and distributing radio frequency and number resources.
