Law On Protection Of Personal Data Comes Into Effect

DocumentsThe law “On Protection of Personal Data” came into effect on January 1. The parliament adopted this law on June 1. The law defines personal data as information to which access is limited.

However, according to the law, information to which access is restricted does not include the personal data of individuals seeking to occupy or occupying elected positions in representative agencies or first-category positions in the civil service.

If information about an individual is added to a database of personal data, the individual must be informed within one month.

The owner of personal data has the right to receive within one month a response to a request about whether his personal data are included in the relevant database and obtain information about the content of the personal data.

This law was prepared in accordance with the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data.

Adoption of this law is one of the conditions that Ukraine was required to meet for liberalization of the European Union’s short-term visas for Ukrainian citizens.

As Ukrainian News earlier reported, the parliament adopted a law entitled “On Protection of Personal Data” in March 2006, and then-president Viktor Yuschenko vetoed this law in April 2006 because it violated the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data.
